Mailworkz does not advocate the use of our products and services in a manner that suggests spamming. In no way can a user of our product disguise where the message is coming from; all information about the source is sent to the recipient. We are strongly opposed to spamming and we will make every effort to deactivate accounts for sending of spam.

Spam or UCE (Unsolicited Commercial Email)

Internet activity that is clearly abusive, hateful or pornographic in nature, inappropriate posting in forums or news groups.

The Mailworkz software and the Mailworkz services may only be used for lawful purposes and in a lawful manner. You must agree to comply with all applicable laws, statutes and regulations. You may not register under a false name or use an invalid or unauthorized credit card. We reserve the right to monitor any activity and content associated with your use of our site, our software, or our services. We may investigate any reported violation of our policies or complaints, and take action we deem appropriate, including issuing warnings, suspending or terminating services, denying access, and/or removing any materials on the site.

We reserve the right to report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators or other third parties.

We reserve the right to access and disclose any information relating to your use of our site, our software, or our services, if we feel, that accessing or disclosing such information is necessary or appropriate in order to comply with any governmental request, protect our reputation, or protect ourselves against potential liability. We reserve the right to remove, screen or edit any content that violates these provisions or is otherwise objectionable to us at our discretion.

We reserve the right to refuse technical support and terminate contracts of any individual who:

1. Sends unsolicited email or
2. Hijacks a mail server relay or
3. Distributes illegal information or materials or
4. Forges header information or
5. Fails to provide a means of unsubscribing from messages

All clients of either the Broadcast software and/or the service are required to agree to a terms of use which clearly outline our policies. Any clients that are in violation of our stated terms will be deactivated without refund.

All mail sent through the Broadcast send service will require an unsubscribe link. All unsubscribes will be processed within a 48 hour period.

Mailworkz does not rent or sell lists of any type or description, nor does it allow its clients to transmit email to third-party, rented, purchased or "harvested" email lists.

This statement applies to those Mailworkz websites and services that display or link to this notice (“Services”). Mailworkz prohibits the use of the Services in any manner associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail ("Spam"). You may not use any Services to send Spam. You also may not deliver Spam or cause Spam to be delivered to any of Mailworkz’ Services or customers.

In addition, e-mail sent, or caused to be sent, to or through the Services may not:

• use or contain invalid or forged headers;
• use or contain invalid or non-existent domain names;
• employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;
• use other means of deceptive addressing;
• use a third party's internet domain name, or be relayed from or through a third party's equipment, without permission of the third party;
• contain false or misleading information in the subject line or otherwise contain false or misleading content;
• fail to comply with additional technical standards described below; or
• otherwise violate the applicable Terms of Use for the Services.

If Mailworkz believes that unauthorized or improper use is being made of any Service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular internet domain, mail server or IP address. Mailworkz may immediately terminate any account on any Service which it determines, in its sole discretion, is transmitting or is otherwise connected with any e-mail that violates this policy.

Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Services. Failure to enforce this policy in every instance does not amount to a waiver of Mailworkz’ rights.

Unauthorized use of the Services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.
